along. i'm jon kelley. marla tellez has the day off. we begin this morning with san francisco city leaders all fed up with a south bay tech company and the private bus service for people who live in the city. they say traffic caused by the big cruisers needs to be and must be regulated. nbc bay area's christie smith is in san francisco with more on the brewing battle there. good morning, christie. >> reporter: good morning, jon. on the one hand, the shuttles are getting people to work and getting cars off the road and getting people to their jobs. on the other hand, a lot of people in san francisco think these shuttle buses that just keep popping up need a little bit more regulations when they are riding on the streets of san francisco. particularly during commute hours. they see some of them blocking bus stops and causing traffic conditions at the height of the morning commute. supervisor john avalos asked for a permit system for shuttle operators. they would have to pay to use muni bus stops or other curb for pick ups and drop offs. san francisco workers use these buss to get to

with us. i'm marla tellez. >> i'm jon kelley. today, opening statements are being heard in the trial of giselle esteban. she is accused of killing michelle le. we have christie smith live at the courthouse with the latest on the trial of giselle esteban. >> reporter: the prosecutor opened with a photo of a smiling michelle le. he showed another photo of what is believed to be her last photo. her walking out of a parking lot and near where she was working. this right before she disappeared. her family packed the courtroom. they did not speak, but wore buttons of the 26-year-old on them. le disappeared in may of 2011 where she was studying nursing. her body found four months later. a former friend of hers, esteban killed her because she had feeling for her boyfriend. i guess we're having problems with that awed oudio. later, he developed a serious relationship with esteban. later, they had a daughter together. he said giselle ruined their relationship. prosecutors said nothing was going on. the defense is up next. opening statements could last all day. the trial is expected to last abo

. i'm marla tellez. >> and i'm jon kelley. we start off with a four-alarm fire at a restaurant disrupting muni service five hours. the blaze started at the squat & gobble cafe across the street from the west portal muni station. that is where christie smith has been live on the scene all day long. any idea how close things are to getting back to normal? >> reporter: we just saw a flare up a couple of minutes ago at the restaurant. firefighters are actually still spraying water on it at this hour. arson investigators haven't gotten a close look inside of the restaurant where part of the roof collapsed overnight. i think you just saw the train go by. muni is back up and running after the complete shutdown at the west portal tunnel. intense flames at west portal. that is how firefighters describe what they were up against. at 6:30 this morning, the fire was upgraded to four alarming. the squat & gobble restaurant had a partial roof collapse and it continued to spread. >> one is a wine shop and a dental office and another set of businesses. three buildings total. >> reporter:s fire

'm jon kelley. good morning action everybody. sad but true, it is getting worse. gas prices closing in on record highs after jumping once again this weekend. since friday prices have jumped another 15 cents right here in the bay area. in fact prices are getting so high they prompted an emergency move from governor jerry brown. bob redell joins us live in cupertino. he has more on this ever-growing story in the wrong direction. bob, good morning. >> reporter: good morning to you, jon. yes, this is an emergency move that's also unprecedented. governor jerry brown has directed the california air reboersz boar resources board to allow the immediate production of the winter blend of gasoline. this should immediately increase the supply of gasoline and in theory lower the prices that you are paying at the pump. we're at the 76 station here in cupertino. this is an extreme. they're charging $5.39 for a regular gallon of gas. you can go elsewhere and find it cheaper, but it's still very expensive. here are the latest numbers from aaa overnight. an average gallon of gas in the bay area is ar

to have you along for the ride. i'm jon kelley. >> and i'm marla tellez. the question here is will he keep his job? after ten months of controversy, today is finally decision day for suspended sheriff ross mirkarimi. christie smith is live in san francisco where the board of supervisors will decide the fate of the embattled sheriff. christie, this case is about a year in the making. >> reporter: yeah, good morning to you, marla. well, this whole ordeal finally expected to come to an end after nine months of legal wrangling and a very public drama that played out here in san francisco. later this afternoon the san francisco board of supervisors expected to finally take a vote on whether or not to remove suspended san francisco sheriff ross mirkarimi from office. it would take nine votes from the 11-member board for that to happen. mirkarimi pleaded guilty after an argument with his wife. she is a tv star from venezuela. in that argument she suffered a bruised arm. mirkarimi is on probation and in counseling and the couple has reunited and said this whole thing was politically motivated. aft

. good morning. >> reporter: good morning to you, laura and jon. yeah, students will officially get the heart-breaking news this morning and of course as you said counselors will be here to help them deal with their grief. cathy qiu was a student in the albany school district since she was in fifth grade. she was a transfer student from the richmond area but i can tell you that wor is already spreading fast about her death. a condolence page is up on facebook with many people offering prayers and remembering her as a very helpful and kind person. she played tennis at albany high, was an honor student with a 4.25 gpa. now, the coroner had identified the 16-year-old after a body washed onshore sunday near half moon bay, but investigators weren't initially sure who it was. but they did get a break from a classmate here at albany high who saw a news report and figured that it might be her. qiu's family reported her missing on september 27th. she was a transfer student, as i mentioned, from richmond and the case is being investigated by richmond police as a possible runaway. police said

-cannon. >> and i'm jon kelley. good morning, everybody. new this morning, safety first. new policy changes go into effect today at a san mateo elementary school where a young girl was sexually assaulted and then dragged off campus more than a week ago. bob redell is live outside parkside elementary school. bob, we're hearing parents will notice these changes as soon as they drop their kids off this morning? >> reporter: you are correct. good morning to you, jon. some of these changes went into effect last week. all of them will be implemented by this morning and they're all designed to make it as difficult as possible for anyone to get onto campus. one of the most obvious changes is they have added this new gate. all the gates, including this one, are now locked. the idea is they want everyone to be going in through one entrance, and that entrance being the main entrance. they are using that as a choke point to be able to see who's coming and going onto the school grounds. parents are no longer allowed to pick up or drop off their child on campus. they can go to the front main entrance but th

. i'm jon kelley. >> and i'm laura garcia-cannon. let's get right to the weather center and meteorologist christina loren this morning. she's tracking the wind and rain for us. a lot going on. >> yeah, there is a lot going on. we told you about this on friday but we were not expecting to get hammered quite this hard this early so let's go ahead and take it right to the live radar. you can see from ft. bragg all the way down to san jose getting steady rainfall. but as i zoom in for you and stop the radar sweeps, you can see right now this is realtime. it's not quite as daunting as it looks when we loop that radar. it's going to get a lot worse as we head through the next few hours. i'm expecting the worst weather between 7:00 and 10:00. right now you're getting hit pretty hard north of the golden gate bridge right now, especially along the marin county coastline. in addition to the wet weather and heavy downpours, we are expecting very gusty winds as welch could force downed trees. we already have power outages. i know you guys are reporting on that so we'll keep you post

>> and i'm jon kelly. good morning, everybody. yes, the damage and destruction all over that east coast this morning in the wake of hurricane sandy, but the hardest hit is new york city, just devastating out there. two people were injured when a total of 50 homes burned overnight in queens and floodwaters there made it very, very difficult for firefighters on that scene to get water pressure there in their hoses to take down those fires. and this morning to talk about all this coverage, we do have team coverage in place of this aftermath of hurricane sandy, now changed to a superstorm. we will get things going out there. we're being told over six million people are without power up and down the east coast. our team coverage will include marla tellez. we also have christina loren will talk about all of that weather and stephanie will be out talking about what's happening as well at sfo. again, 50 plus homes have been destroyed out there, worse than irene they're being told. but let's take it live right now. nbc is covering this for us up and down the east coast. daniel lee is live

'm marla tellez. >> and i'm jon kelley. good morning, everybody. it was a deadly night out on the streets of san jose as police investigate two separate homicides just four hours and only four miles apart. homicides number 35 and 36 this year alone. bob redell is live at the police department. you just attended a press conference there, getting more information about the latest run of violence. bob, good morning. >> reporter: good morning to you, jon. san jose in the past has prided itself on being america's safest big city has just racked up homicides number 35 and 36 for the year. police believe one of them is gang-related. when we spoke with sapd within the past hour, the officer wondered if the city's still had its gang tax force if that task force was still intact. a group of friends were celebrating one of their birthdays outside a house. one of them tells us two member, gang members, he believes, barged into the party and shot and killed his friend. a man in his 30s with a wife and child. he doesn't understand why his friend would be targeted, says he wasn't a gang-banger. describe
